OFFICIAL CONTEST RULES AND REGULATIONS
1. How to participate
1.1 How to Enter: By entering the 'SkiGraphiks Contest by G3 and Backcountry Magazine', you ('the Contestant') AGREE to be bound by these Official Rules and Regulations of the Contest and by all decisions of Genuine Guide Gear Inc. (G3). You may enter the Contest by going to www.skigraphiks.com and then following the instructions listed. The Web page will provide you with a Template that you need to download in order to enter the Contest. You may use a computer or conventional art supplies to design a ski topsheet. Your design needs to be submitted to G3 as required by the instructions supplied. The Entry must comply with all instructions of the Contest and all of the Rules in order to be eligible. Entries must be submitted to the Contest by e-mail only. Upon completion, each Entry will be deemed an eligible Entry upon being received and approved by G3 and will be entered into the Contest for One (1) chance to win the Prize.G3 will not acknowledge receipt of Entries. Entries will not be returned to Contestants. Entries submitted to contest become the property of G3.
1.2 Eligibility: The Contest is open to all who, at the time of entry, are eighteen (18) years or older, or if under the age of 18 the entry must be accompanied by a consent form signed by a parent/guardian.
1.25 Upon entering the contest all contestants agree to (i) comply with all contest rules; (ii) accept of the Prize on the terms and conditions as offered if judged a winner; (iii) acknowledge the non-responsibility of G3 and their respective agents in respect to any injuries, loss, or misfortune related to the Contest or the Prize; and (iv) acknowledge that G3 and its agents have an unrestricted right to publish, in its discretion, such Winner’s name, photograph, portrait, likeness, voice and any film rendering or tape recording of such Winner for advertising and promotional purposes in connection with the Contest in any form of publication or display including, without limitation, newspapers and other print publications, radio and television broadcasts, film releases and interactive media worldwide without compensation other than the Prize offered.
1.3 Contest Period: G3 will begin accepting Entries for the Contest on September 1, 2012. Entries must be received by G3 no later than Five (5) PM Pacific Standard Time on the last day of the contest, November 30, 2012, to be eligible for the contest. There is only one contest round in this year's contest, spanning three months. G3 is not responsible for any late, lost, stolen, damaged, delayed, incomplete, ineligible or misdirected Entries.
2. Prizes
2.1 Prizes: Each month a 'People's Choice' award will be given to the entry deemed to be most popular. Contest judges will identify the most popular entry by considering a combination of votes, comments, and shares – not just on votes alone. People's Choice winners will receive a set of G3 Alpinist Climbing Skins and a Backcountry Magazine hat, T-shirt, and one-year magazine subscription. The Prize has no cash value and is non-transferrable. Prize delivery could take six or more weeks from the date of winner selection. The Grand Prize Winner will be announced on or about 14 days after the overall contest ends November 30, 2012. The Grand Prize Winner will be selected solely by the Contest Judges and not by popular vote. The Contest Judges will select the winning ski graphic design entry based on what G3 and Backcountry Magazine feel is the strongest design and best fit. The Grand Prize winner will receive a prize pack valued at over $1500, comprised of one (1) pair of G3 District skis with the entrant's winning topsheet grahpic, one (1) pair of G3 bindings, one (1) pair of G3 skins, one Backcountry Magazine hat, one T-shirt, and a one-year subscription to Backcountry Magazine.2.2 Prize Odds: The odds of winning the Contest are dependent upon the number of Entries received by G3 for the Contest. G3 reserves the sole right to cancel, modify or suspend the Contest at any time without any liability to any Contestant.
2.3 Prize Selection: A panel of Three (3) Judges appointed by G3 and Backcountry Magazine will evaluate all eligible Entries and will select the People's Choice Winners and the Grand Prize Winner. Selection of the People's Choice winners will be based on the number of votes, shares, and number/quality of comments for each entry. Selection of the Grand Prize Winner is solely the discretion of the judging panel. All decisions made by G3 with respect to all aspects of the Contest are final and binding on all Contestants.
2.4 Notification of Selection: G3 will attempt to contact the Winners based on the information supplied with the entry. If a Winner cannot be reached within four (4) business days of the Judging Date, then the Winner will no longer be eligible to win the Contest. An alternative Winner will be selected from the remaining eligible Entries received. Prior to receiving a Prize, each Winner is required to sign a release form agreeing to all contest rules and giving all rights to the work to G3 in exchange for accepting the award. In the event of a minor being declared a Winner the release form must be signed by a parent or legal guardian. If a Winner is unwilling or unable to comply with the Official Contest Rules and Regulations, such Winner will be disqualified and another Entry will be selected from the remaining eligible Entries received.
2.5 Winner Obligations: As a part of the contest conditions, the Grand Prize winner agrees to provide minimum one (1) blog post with accompanying photos, showing his/her prize in use on snow, for G3's use on the G3 Houseblend blog.
3 Copyright
3.1 Intellectual Property Rights: The Contestant warrants that he/she is the owner of all copyright and other intellectual property rights in and to the Design; that he/she is the sole creator of the Design; that the Design is original; that the Design is not defamatory and does not contain any obscene or blasphemous material; that he/she has all necessary contents and permissions in writing and signed from any and all individuals, locations, venues and other third parties portrayed or otherwise featured in the Design; that use of the Entry by G3 will not infringe the worldwide copyright or other worldwide intellectual property rights of any third party or create any other liability for G3 and will not in any way be unlawful; that he/she will not be in breach of any contractual or other pre-existing obligation that is binding upon them. The name “G3 Genuine Guide Gear”, the name “Skigraphiks” and the symbol “G3”, and all derivations thereof, and the content of www.genuineguidegear.com, including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features, and the like and all the registered and unregistered trade marks, service marks and logos contained therein, are owned or licensed to G3, subject to copyright and other intellectual property rights. Content on the Website is provided to you AS IS for your information and personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners. G3 reserves all rights not expressly granted in and to the Website and the Content. You agree to not engage in the use, copying, or distribution of any of the above-described intellectual property for any commercial purposes.3.2 Design Rights: By participating in this Contest, the Contestant ACKNOWLEDGES AND TRANSFERS and RELEASES to G3 all legal rights that the Contestant has to the Design. The Design becomes property of G3 upon submission of the Entry. G3 has the authority and legal right to use the Design in any way that G3 deems appropriate, including but not limited to: any form of publication or display including, without limitation, newspapers and other print publications, radio and television broadcasts, film releases and interactive media worldwide. G3 has the right to amend, change, revise, alter or incorporate all or part the Design, in whole or in part any way that G3 may so desire.
3.3 Governing Law and Jurisdiction: This Contest and the application or interpretation of the Official Contest Rules and Regulations shall be governed by the applicable laws of Canada and of the Province of British Columbia and each Contestant irrevocably agrees attorns to the jurisdiction of the courts of the Province of British Columbia.
3.4 Privacy/Use of Personal Information: By participating in the Contest, the Contestant: (a) grants to G3 the right to use his/her name, mailing address, telephone number, and e-mail address for the purpose of administering the Contest, including but not limited to contacting and announcing the Winners; (b) grants to the Sponsors the right to use his/her Personal Information for publicity and promotional purposes relating to the Contest, in any and all media now known or hereafter devised, without further compensation unless prohibited by law; and (c) acknowledges that G3 may disclose his/her Personal Information to third-party agents and service providers in connection with any of the activities listed in (a) and (b) above.
3.5 Interpretation: In the event of any discrepancy or inconsistency between the terms and conditions of these Official Contest Rules and Regulations and disclosures or other statements contained in any Contest-related materials, including but not limited to the Contest entry form, or point of sale, television, print or online advertising, the terms and conditions of these Official Contest Rules and Regulations shall prevail, govern and control.
3.6 All decisions made by G3 are final. The prize is not redeemable in cash and must be accepted as awarded. Approximate value of prizes vary. This contest is subject to all federal, state and local laws. Winners are responsible for all local, state and federal taxes on the prizes.
